Terms of Sale

These Terms of Sale apply to purchases of original and commissioned artwork.
By completing a purchase, collectors acknowledge and accept the applicable terms below, subject to rights provided by applicable law.
 
Final Sale Policy
All original and commissioned artwork is considered final sale.
Returns, exchanges, refunds and voluntary order cancellations are not accepted except where expressly agreed to in writing or required by applicable law.
Collectors are encouraged to carefully review artwork descriptions, photographs, dimensions, materials and purchase details before completing a transaction.

Original Artwork
Each original artwork is a one-of-a-kind creation.
Once purchased, the artwork is removed from availability and reserved exclusively for the collector.
Original artwork cannot be returned, exchanged or voluntarily cancelled because of a change of mind, personal preference, sizing concerns or other circumstances unrelated to an issue with the order.

Commissioned Artwork
Commissioned artwork is created specifically for the individual collector and is considered final sale.
All commissions are governed by a separate Commission Agreement provided before work begins.
Commission deposits become non-refundable once work has commenced, except where otherwise agreed in writing or required by applicable law.
If a collector requests termination of a commission after work has begun, any outstanding payments, refunds or other obligations will be determined in accordance with the Commission Agreement.
Commissioned artwork represents the artist's original interpretation of the collector's chosen inspiration, story, emotion, music or creative direction.
Reference materials and discussions are intended to guide the creative process rather than establish an expectation of exact reproduction.
The artist retains creative discretion within the agreed scope of the commission.

Handmade Characteristics
Original artwork is created by hand and may contain intentional irregularities, visible brushwork, texture, markings and variations in surface or finish.
Artwork created on raw or unstretched canvas may feature irregular edges, natural surface variations or slight dimensional differences.
These characteristics are inherent to the artwork and are not considered defects.

Colour & Digital Representation
Every reasonable effort is made to represent artwork accurately.
Colours, textures and surface details may appear differently in person due to photography, lighting conditions, screen calibration and individual device settings.
Minor variations between digital representations and the physical artwork are not considered defects.

Pricing & Payment
Prices are displayed in the currency identified at checkout or on the applicable invoice.
Applicable taxes, shipping costs and other mandatory charges will be disclosed before purchase where required.
Original artwork must be paid for in full before shipment unless otherwise agreed in writing.
Commission deposits, payment schedules and outstanding balances are governed by the applicable.

Commission Agreement.
Artwork is not considered reserved until payment has been successfully received or another written arrangement has been confirmed.

Damaged or Incorrect Artwork
If an artwork arrives damaged or an incorrect artwork is received, please contact the studio as soon as reasonably possible after delivery.
Please provide the applicable purchase details, a description of the issue and clear photographs of the artwork and packaging.
Collectors should retain the original packaging while the issue is being reviewed, as it may be required for a shipping claim.
Depending on the circumstances and applicable law, an appropriate resolution may include repair, replacement where possible, credit or refund.
Because original and commissioned artworks are unique, an identical replacement may not be possible.

Consumer Rights
Nothing in these Terms of Sale is intended to exclude, restrict or waive rights or remedies that cannot lawfully be excluded or restricted under applicable consumer protection legislation.
Where these terms conflict with a mandatory legal requirement, the applicable law will govern.

Changes to These Terms
These terms may be updated periodically.
The version in effect at the time of purchase will generally apply to that transaction, except where otherwise required by law or agreed in writing.
